Holiday and Comfort Zone Essay The scorching hot sun was beating down on my bare pale skin, the warm light breeze gently brushed through my blonde hair and the cool, shimmery, turquoise water soothed my skin. The smell of coconuts and pina coladas whirled in from the snack bar and the fresh salty air made my whole body calm and relaxed. This is just how the vacation of my lifetime would start and It would soon be my favorite place in the world to visit. My vacation in Mexico brought many exciting adventures and new experiences that brought a positive insight in me as it made me break out of my comfort zone, made me want to travel the world more often, and also to get involved and make a difference in the world. As I glanced out the window on the bus ride to the resort, I couldnââ¬â¢t help but stare at the beautiful scenery that was surrounded all around me. I was ecstatic because I was looking at the most alluring scenery I have ever seen in my life and I knew at this moment I never wanted to go back home. In the whistling wind, the palm trees swayed side to side while brushing against each other and slightly hitting my window. I heard a screeching, loud noise from the brakes and then I finally realized we had arrived at our final destination. As I stepped off the bus, I could smell the salty, clean and fresh air right away and an empty but warm breeze blew against my face. ââ¬Å"Taylor wait for us! We donââ¬â¢t want you to get lost! â⬠My family yelled as I had already started running over to the lobby in excitement. When we got assigned our room we walked around the resort and thatââ¬â¢s when it all had hit me. With my mouth wide open, all I could say was, ââ¬Å"this place is absolutely breathtaking. â⬠As we went around to the back, there were 4 fairly large pools on both sides of me, and chairs directly around each of the pools. In the blink of an eye I noticed the beach up ahead of me and I have never seen something more beautiful, serene and relaxing. The sinking feeling as my feet step into the fine, white sand as it started to burn the soles of my feet, I dragged myself over to the shoreline and stepped into the water while it soothed my feet. The beach was a scorching furnace, as I felt it slowly burn my body and my face and the sweat on me was a river running down my forehead. As the day ended, I lay myself in my bed and my thoughts were consumed by all of the stunning scenery that I had witnessed that day in this beautiful and enchanting location and I started to think about it more and more and it made me realize that when Iââ¬â¢m older I want to travel the world and witness all the different locations and the beautiful scenery they have to offer and learn about different cultures. I woke up the next morning and jumped out of my bed as I was thrilled to start off the day with a bunch of fun and adventurous activities that Iââ¬â¢ve never experienced before. ââ¬Å"Taylor, would you like to swim with the dolphins today and go zip lining? â⬠my mom said as my eyes were wide open and had the biggest smile on my face, I couldnââ¬â¢t help but scream ââ¬Å"YES! â⬠. As we got our stuff packed and soothed the sunscreen all over our body, we were set to go. The water was splashing against our legs and the warm breeze whistled through our hair and the smell of the salty clean air overhead as we walked over to the hut where I would soon experience one of my most memorable moments. As we got into the water, Melanie the dolphin came gliding across the water as we all lined up and pet her. The best part of this whole experience was getting a ride on the dolphin while I held onto her fins and she glided across the whole water.. Dolphins are definitely the most graceful and intelligent sea creatures and the way they interacted and understood us was absolutely outstanding. Also, it was really interesting and heartbreaking learning about the dolphins and how not many of them are surviving because they are being slaughtered and they are dying from toxic exposure. As a result, the dolphins made a huge impact on my life because once I heard what was happening to the dolphins it touched deep into my heart and made me want to make a difference in the world and stop the cruelness of people slaughtering and taking advantage of them. Afterwards, we went over to the zip lining and I couldnââ¬â¢t help but have that stomach drop feeling as we got there. I was standing at the very top and almost ready to go and my fear of heights was almost sickening me out but I knew I had to experience this. My feet lifted off of the platform and I felt pretty comfortable as I felt like I was a superhero for a couple of minutes. I was soaring over the stunning beach and the palm trees just below me and all I could say in my head was, ââ¬Å"this view is just outstandingâ⬠and I wish I could stay in that moment forever. For the most part, today I took a leap of faith out of my comfort zone as there was a huge adrenaline rush in me as I was about to soar really high, but being able to experience this made me want to go out and try new things that I could eventually overcome my fear of because life begins just beyond your comfort zone. A day to remember, I will never forget these astonishing experiences that I spent with the lovely dolphins and zip lining over the most gorgeous view. The climate in Mexico made it the best part because without it I wouldnââ¬â¢t have enjoyed the memorable and adventurous activities that I will cherish forever. Since we were in Mexico in February it was sunny almost every day and when it did rain it would only rain for a short period of time during the day. Since it was hot and sunny most of the time, we got a much better experience with the friendly dolphins, zip lining over a tremendous view and other adventurous activities that we will never forget. Also, with this weather I got a golden brown tan from the beaming rays of the sun. However, some days the humidity was really high and it felt as humid as a steam room, as the moist heat stuck to my body. By the middle of the day temperatures can reach up to about 40 degrees, where the sun is just scorching on my body. Without the beautiful weather, my experiences and memorable moments wouldnââ¬â¢t be enjoyed as much and I got a nice golden brown tan. Also with this being said, the bright, warm and sunny summer days encouraged me to think about traveling to a numerous of warm climate places and also experience other vacations where the climate is different. Early in the morning, we exhaustingly started to pack our bags and head off to the airport and as soon as I got on the plane my mind was filled with reflections from my unforgettable vacation. My vacation in Mexico brought many exciting adventures and new experiences that brought a positive insight in me as it made me break out of my comfort zone, made me want to travel the world more often, and also to get involved and make a difference in the world. The lovely scenery made me want to stay in this gorgeous place forever, experiencing new activities in a different location made for a lot of memorable moments that Iââ¬â¢ll remember forever, and without the comfortable climate I wouldnââ¬â¢t have enjoyed the trip as much as I did.

The Doctrine Of Judicial Precedent Law Essay Judicial precedent also called case law. It is the system adopted by judges where the judges follow previous decisions.1It simply means that the previous decision made by judges in similar cases are binding upon future cases depending on the hierarchy of the court. Therefore, under judicial precedent, a lower court is bound to follow the decision made by a higher court when there is a case which has similar material facts to a case that has decided by a higher court. Whether or not the decision is correct, a court is bound to follow the ratio of any decision by a court above it in the hierarchy. For example, according to the hierarchy of the court system in Malaysia, Court of Appeal, High Court and Sessions Court is under Federal Court. Therefore, Federal Court decision automatically binds the Court of Appeal, High Court and Sessions Court. The diagram of hierarchy refers to appendix 1. In English Law, the system of binding precedent is called stare decisis. The principle of stare decisis involves ratio decidendi and obiter dictum. Ratio decidendi is the legal principle of the case which is binding on the lower courts. It is also the reason for deciding.2 Nevertheless, obiter dictum is not binding on the lower courts. Obiter dictum is comments made by the judges.3It means that incidental remarks by a judge which is persuasive only.4 Therefore, the judges have the choice whether to follow or not to follow. If the judges is setting a new precedent and merely making new law because there is a case before him is without precedent then it is called original precedent. However, is the judges is just merely applies an existing rule of law then it is called declaratory precedent. In the case of Donoghue v Stevenson 5, it is about the plaintiff, Mrs Donoghue went to a cafà © with a friend, who had bought her a drink of ginger beer. She had poured some of the drink into a glass and consumed it. After drinking most of it, she found a decomposed snail inside the bottle while she drinking the ginger beer. After that, Mrs Donoghue became unwell and ill. So, she decided to sue the manufacturer of the ginger beer who is the defendant. On that time, the usual remedy for damage caused by a defective product would be an action in contract. Nevertheless, Mrs Donoghue did not have any contract with the manufacturer of ginger beer even the cafà © owner. The one who have contract with the cafà © owner is Mrs Donoghues friend. This is because the ginger beer is bought by her friend but not Mrs Donoghue herself. Although Mrs Donoghues friend have contract with the cafà © owner, her friend also cannot sued for remedy damage because her friend did not get hurt by the ginger beer. As ginger beer was not a dangerous product, and the manufacturer had not fraudulently misrepresented it, the case also fell outside the scope of the established cases on product liability. 6 The House of Lords had state that the manufacturer of ginger beer owed a duty of care to the Mrs Donoghue. The manufacturer of ginger beer must have duty of care to the end customer of its products. In this case, the manufacture of ginger beer had breached the duty of care. Therefore, Mrs Donoghue is entitled for the remedy of damages. This case is binding on the lower courts because this was a unique case it was decided to first establish. Once this ratio or legal precedent was established other similar claims are followed. After that, there is another case which is Grant v Australian Knitting Mills Ltd .7 This case is closely related to the Donoghue v Stevenson case. In Grant v Australian Knitting Mills Ltd case, Dr Grant, the plaintiff had bought an undergarment from a retailer. The undergarment is manufactured by the defendant, Australian Knitting Mills Ltd. Dr Grant was contracted dermatitis. The undergarment was in a defective condition owing to the presence of excess of sulphite. It was found that the manufacturer had been negligently left in it in the process of manufacture. In this case, the buyer sued the retailer in contract and the manufacturer in tort. The Privy Council held that the defendants were liable to the plaintiff although there is no privity between Dr Grant and the manufacturer. The decision of this case is bound to the Donoghue v Stevenson case since there are similar cases. Here, In 2010, Mr. Justice Peter, a higher court judge sitting alone in deciding a case which has similar material facts to one decided by the Court of Appeal in 2009. The first advantage is uniformity. Everyone is treated equally1 and will get same punishment for the same case or offence. For example, in the case of Donoghue v Stevenson (1932) AC 562, the decision is Mrs Donoghue is entitled for the remedy of damages in the case. Therefore after that, this case is bind. So when there is case which has similar facts with this case Grant v Australian Knitting Mills Ltd (1936) AC 85, the plaintiff is entitled for the claims of damages by following the case of Donoghue v Stevenson. When Grant v Australian Knitting Mills Ltd (1936) AC 85 happened, the lawyer can roughly know what is the punishment or solution to settle up this case as previously there is a similar case Donoghue v Stevenson (1932) AC 562 happened and the judges have to bind and follow the decision. Predictability is the third advantage. This is because when there are cases that have similar materials facts with the previous cases, the lawyers can roughly know what is the outcome of the new case. By forecasting the outcome of the case, the lawyers can tell their clients the percentage of the winning rate. [Donoghue v Stevenson (1932) and Grant v Australian Knitting Mills Ltd (1936)] So, the lawyer can refer to Donoghue v Stevenson (1932) and tell their clients what is the percentage of winning the case and what are the solutions for that case or is it worth to continue up this case. Besides, the other advantage of case law is less legal cost incurred. This is because the case can be resolved and settled quickly3. When there is a decisions made by judges previously on similar material facts, they can save money. This is because there already have the previous examples, so they can settle the case quickly as they can follow the decisions of the previous one. Then this can shorten the duration of the case, and this can help to save up the legal costs that need to be paid. Other than that, personality of the judges will not influence the outcome of a dispute in court as judges will be bound to follow the previous decisions.4 When there is judicial precedent, the judges cannot make the decision by its own thinking or idea which might influence the offender future. This is because every person got their own personalities, included the judges themselves. So one of the advantages is the judges have to follow the previous decisions. So that everyone will get the same punishment and this is fair for everyone. On the other hand, case law has its disadvantages too which we known it as weaknesses. One of the weaknesses is bulky and complex. Sometimes there are too many cases and too many laws that no one can learn all of it.5 When there is a case happened which have the similar material facts with previous one, the lawyer has to refer to the previous case. When lawyer need to read all the cases and refer to them, it is quite complicated for lawyers as they do not know what is the best reference. For example, in the case of Phillips v Brooks [1919] 2 KB 243 Horridge J and Ingram v Little [1960] 3 All ER 332, CA. The results of these 2 cases are different, but there are similarity facts. Then, in the next case [Lewis v Averay [1971] 3 All ER 907, CA] the judges decided to follow the decision of Phillips v Brooks and doubting Ingram v Little. If the lawyer feels that the chance of winning is higher after see the result of case Ingram v Little, at the end it might disappointed them. So, it is so complicated and bulky for the lawyers as they cannot decide which one is the best refe rence for them. In addition of that, sometimes it is rigidity or not flexible which means that it may sometimes cause hardship.6 Once it is created it is binding until it is being overruled.7 When there are bad decisions made on previous cases, the new case which has the similar material facts with it has to follow the bad decision too. It is so unfair for them. Lastly, we know that only the ratio of the case is binding in a case.8 So the weakness of case law is sometimes the ratio decidendi of a case is very difficult to find. So the problem occurs when it is very difficult to tell which part is the ratio decidendi and which is the obiter dictum of the case. For example in the case of Donoghue v Stevenson (1932) AC 562, the House of Lords said the manufacturers had a duty of care to the consumer of their product. Then, this decision that the House of Lords made is certainly encouraging subsequent judges to break out of the shackles of the past, it was thought at the time to be obiter and was regarded as too wide a statement of the law. However, it was approved by Lord Reid in Home Office v Dorset Yacht [1970] 2 All ER 294 by saying that it is ought to apply unless there is some justification or valid explanation for its exclusion. Thus, the principle is now treated as ratio at least in relation to physical injury and damage to property whic h subject to certain limitations. The Internet fosters free speech on a global scale."[1] Introduction The Internet provides a gateway for an individual to speak freely and anonymously without being targeted to what he or she said. With this said, one of the biggest issues concerning the Internet today is freedom of speech. The issue of free speech on the Internet has been a topic of discussion around the world within the past years. It is a unique communication medium and is powerful than the traditional media[2]. Because the Internet can not be compared equally to other mediums of communication, it deserves the utmost freedom of speech protection from the government. My name is Bob Thomas. My life has been one hell of a roller coaster, with enough ups and downs to make anyone nauseas. I guess I shouldnââ¬â¢t complain, because that is a common lifestyle for most people. It all started when I was a teenager and it is a familiar fact that every teenager has their fair amount of rows, with there parents. However, one argument was just one to many for me. It was actually quite pathetic; I look back and laugh at what I was arguing about. This sounds silly but I was quarrelling, with my mum, on whether I could wear my suede boots to school. It all ended up with me storming out of the door saying that I was deprived of my freedom and opinion. I could remember hearing my dad in the background, shouting at the top of his lungs, that I shouldnââ¬â¢t dare step foot out of the house. But I did. I was confused and angry, so I just wanted to be as far away from home as possible. Using the money I had on me, I took a train to London without even realizing or noticing how dim-witted I was being. At that point all I wanted to see was that lousy excuse for a mother, dead. The area I picked in London was an awful mistake. I was living on the streets with no money, no job, nothing. And to add to that, these unpleasant people would come up to me and stare. And then there were the occasional perverts hanging around, but I kept myself hidden when I saw them lurking about. I tried to make life work, by scavenging for anything I could get my hands on. I couldnââ¬â¢t think of asking my parents for help, it was just out of the question. I had been gone to long, I could imagine the angry looks on their faces, describing the pain I had put them through. What if they didnââ¬â¢t even want me back? They seemed quite content with my sister. They had probably forgotten

As Sentse, Lindenberg, Omvlee, Ormel & Veenstra (2009) stated, the need to belong is one of the most important need of an individual, and during adolescence, the closest group of people that an adolescent could have strong attachments with is his/her family and friends. In a study by Khurshid & Rehman (2006), those who have low self-esteem were reported to have higher peer stressors as compared to others having high self-esteem. Their findings suggested that those who have low self-esteem face more problems with their peers; that because they lack in self-confidence, their peers would see them as inferior, considered them as a boring personality and that they always felt uncomfortable in the company of strangers, even among their friends. According to the study conducted by Parker et al. as cited in Kistner, David & Repper, 2007), the perception of an individual to be accepted by peers would contribute to his/her adjustment in school or in any other areas of his/her life. Rejected individuals who perceived themselves to be accepted by their peers tend to cope with and initiate social interactions better, than those who were rejected having negative perceptions of themselves being accepted (Rabiner & Coie as cited in Kistner, David & Repper, 2007). It was stated by Furman & Robbins (as cited in Kingery, Erdley & Marshall, 2011) that having the companion of peers would provide intimacy, affection and a source of reliance for an individual, thus helping in his/her adjustment and help enhance self-esteem. Behavioral Indicators: Individual feels that she belongs to a certain group; feels that she is not alone in life; accepts criticisms from other people; does not find it difficult to socialize with peers.

Barn Burning by William Faulkner Essay
For years, literary works have discussed the difference of nature vs. nurture, William Faulknerââ¬â¢s Barn Burning being one of them. Nurture in the debate refers to the way a person is brought up through his or her life. The argument is that the nurturing of the child in its early years is what ultimately defines how that person will act. On the other hand, another way of thinking is that nature defines who a person is. That it is not how a person is raised or what they grew up around, but who that person is inside. The fundamental difference is that said person is born the way they are going to grow up to be and is not shaped by his or her parents and how they act. In Faulknerââ¬â¢s Barn Burning, Sartoris Snopes is nurtured by his ill-willed father but ultimately takes the high road and chooses to be his own person rather than follow the road of his father. Sartorisââ¬â¢ life had previously been defined by instability and always covering for his father, until they came along the de Spain house. From the beginning of the story, Sartoris wanted to tell the truth at the court room but got slapped by his father for even the thought. ââ¬Å"Youââ¬â¢re getting to be a man. You got to learn. You got to learn to stick to your own blood or you ainââ¬â¢t going to have any blood to stick to you. Do you think either of them, any man there this morning would?â⬠Mr. Snopes was just trying to make sure that his son would always protect his twisted ways in any future court room. He did not care about teaching his son a life lesson about loyalty or that blood was thicker than water, which was not what the talk that night in the woods was about. It was just simply Mr. Snopes warped way of assuring he would not get in trouble for future acts of harm. And sure enough, there were more acts. Even though Mr. Snopes slapped Sartoris and told him to stay true to his family, the de Spain house sparked a change in Sartoris and marked the end of following his fatherââ¬â¢s footsteps. His fatherââ¬â¢s way of raising him was almost a reign of terror. No one ever knew what to expect from him. He was not a good man in any sense of the word. He stole horses in the war from the Confederacy for his own benefit, having no loyalties to either side. The only loyalty he has ever had has been to himself. His wounded leg, as a result of the war, symbolizes the weight he carries around by living his perverse way of life. That is, feeding off of the harm he has caused to others; he has always felt that most people have short-handed him. The incident in the story in which Mr. Snopes ruined the one hundred dollar rug focused on how the leg was the major part of his body that took part in the smearing of the dung. It also was the main factor that let the de Spainââ¬â¢s know he had retur ned the ruined rug. Once they realized that he had permanently altered the rug, it was back to court for the Snopes family. Again, Sartoris witnessed his father being untruthful in the court of law and again his innate nature was to tell the truth. Yet always in the background is the gnawing feeling of what his father would do to him if he was disloyal. So when does he go against what he was raised to do and become his own person? Sartorisââ¬â¢ entire life had been to follow behind his father without question if it was right or wrong. As a small child he might not have wondered whether Snopesââ¬â¢ actions were morally acceptable or not, but as he grew older and developed his own conscious, he soon realized that he was a different person with a different way of thinking than his father. For his father, barn burning was his way of releasing anger and getting back at the people who have done wrong in his mind. Even though the nigger at the de Spain house did not do anything perso nal to him, Snope thought that because he told him he could not be on the rug, that he should destroy it so no one else could be on it either (symbolically.)
